CHILI Movie Rental for MyMcDonald’s Rewards Customers - Terms and Conditions

These are the terms and conditions for the CHILI Movie Rental for MyMcDonald’s Rewards Cutomers promotion (the Promotion) (the Terms). Claim and redemption instructions are deemed to form part of these Terms, although these Terms prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

1. Promotion
   1. This Promotion is promoted by McDonald's Restaurants Limited, 11-59 High Road, East Finchley, London N2 8AW ("McDonald's"). The Promotion is subject to these Terms. By participating in the Promotion (or any part of it), you, the participant, agree to be bound by and accept these Terms.
2. Eligibility
   1. In order to be eligible to participate in this Promotion, the participant must: (a) have downloaded, registered and signed-in with the official McDonald's (UK) App (the "App"); (b) have, by 09:00:00 on 16th August 2023, registered for a MyMcDonald's Rewards ("MMR") account within the App and opted in to receive email and newsletter communications; (c) be aged 18 or over and resident in the UK (including Northern Ireland); and (d) be eligible under these Terms.
   2. Participation in the Promotion and use of the service provided by CHILI S.p.A (CHILI) requires the participant to have a CHILI account (which may be pre-existing or newly created). A CHILI account can be created via https://uk.chili.com/registration. You must be 18 years of age or older and agree to the CHILI terms and conditions (located at https://uk.chili.com/terms-and-conditions) to sign up to the CHILI service. There is no charge for setting up or holding a CHILI account.
   3. In order to participate in the Promotion and use the CHILI service, a participant is required to have internet access and a compatible device, neither of which are provided as part of the Promotion.
3. Promotional Offer
   1. The promotion comprises of one (1) movie rental code from the CHILI platform per eligible MMR account.
   2. On 16th August 2023, eligible MMR customers will receive an email (to the email address which has been used to register the corresponding MMR account) containing an activation code and a link to the partner claim site where the respective customer can claim a movie rental code which can be used to obtain a free qualifying movie rental from CHILI’s catalogue in the UK (excluding PVOD), through uk.chili.com/promotion, subject always to these Terms.
   3. To claim a movie rental code, the eligible MMR customer must click on the link to the partner claim site contained in the email sent to them by McDonald’s and complete the claim form before 23:59 on 5th September 2023, by entering the unique activation code, their first name and the email address that the code was sent to. Once entry on the partner claim site is complete, the participant will be emailed (to the email address which has been used to register the MMR account) a movie rental code for one (1) free qualifying movie from CHILI’s catalogue in the UK (excluding PVOD) together with instructions to redeem and a link to the CHILI movie site.
   4. Activation codes are valid from 00:01 on 16th August and 23:59 on 5th September 2023. The movie rental code for use on the CHILI platform must also be activated and used to select a qualifying movie between 00:01 on 16th August and 23:59 on 5th September 2023.
   5. Each activation code and movie rental code can only be used once and cannot be redeemed after 5th September 2023. Codes cannot be used in association with any other promotion.
   6. A movie rental code: (a) entitles a customer to rent a movie in any format within CHILI’s digital catalogue in the UK, excluding PVOD “Home Premiere” titles; (b) is valid for film rentals only; (c) cannot be used to purchase films and TV series from the CHILI store.
   7. Once a CHILI movie rental code has been activated and used to select a qualifying movie, the chosen movie must be watched within 28 days and from the first time the customer presses “play”, the movie must be watched within 48 hours.
   8. Movie rental codes are not to be used for financial gain in resale and are subject to any other applicable terms including, but not limited to, CHILI’s terms of use found at https://uk.chili.com/terms-and-conditions. Normal film classification rules apply.
   9. Failure of the participant to comply with these Terms (including any deadlines therein) and other instructions of McDonald's at any stage during the claim and fulfilment process (whether or not communicated via an agent) may result (in McDonald's sole discretion) in the promotional offer being withheld and the applicable claim being deemed void for all purposes.
4. Responsibility
   1. If using a device, computer and/or internet-access which is not owned or paid for by the participant, the participant is reminded to obtain the owner's permission before participating in the Promotion or using the CHILI platform. Neither McDonald's nor CHILI will be liable for any internet, mobile connection or other charges incurred whilst participating in the Promotion (or any part of it).
   2. McDonald's does not guarantee continuous uninterrupted access to the dedicated McDonald’s landing page or to the CHILI Movie site. McDonald's takes no responsibility for claims that are delayed, incomplete, invalid or lost due to technical reasons or otherwise. Proof of sending will not be accepted as proof of delivery.
   3. McDonald’s and CHILI are not responsible for destroyed, lost or stolen activation or movie rental codes, or their unauthorized use.
   4. Participation in the Promotion is at the participant’s sole risk. To the fullest extent permitted by applicable law (but not otherwise) McDonald's, its agents and/or commercial partners assume no responsibility and are not liable for: (i) the accuracy or otherwise of any promotional description or illustration; (ii) (where applicable) the non-availability, loss, late receipt or damage of any text, claim, notification or other communication and whether by reason of mobile-telephone network-operator error or other problem, failed or corrupted transmission, handset failure (including full or unserviceable inbox) or otherwise; (iii) (other than those warranties or conditions implied by statute and which cannot be excluded) any representation, warranty, condition or guarantee in respect of the movie rental codes, movies or CHILI service; or (iv) any taxes, fees, charges or other costs which a participant may be required to pay in connection with participation in the Promotion.
   5. Nothing in these Terms will limit McDonald's liability for death or personal injury caused by its negligence or for fraud, or any other liability which cannot be excluded or limited under applicable law. This does not affect a participant’s statutory rights.
5. Privacy
   1. Any personal data captured in the fulfilment of the Promotion will only be used for validation of claims, notification and administering the Promotion, unless you have expressly consented for it to be used for any other purposes (for example, in subscribing to McDonald’s marketing newsletters). To understand how McDonald’s uses and protects your personal data, please see McDonald’s Privacy Statement https://www.mcdonalds.com/gb/en-gb/privacy-policy.html . By participating in the Promotion, you agree to the use of your personal data as described in these Terms.
   2. Please note CHILI (whether in addition to or in place of a participant providing personal data to McDonald’s) may require a participant to provide personal-data to CHILI in connection with account creation, account administration and/or claiming or redeeming any products or services offered by CHILI, so participants should review and satisfy themselves with CHILI’s privacy policy, as McDonald’s cannot accept any responsibility for this or any loss or damage that may arise from use of the CHILI service and platform.
6. General
   1. There is no cash alternative (in whole or in part). Activation codes and movie rental codes cannot be sold, transferred, returned, exchanged or redeemed for cash.
   2. McDonald’s reserves the right to disqualify without notice any participant if McDonald’s believes, in its absolute discretion, that the participant has acted fraudulently or dishonestly, tampered with or attempted to disrupt or tamper with the operation of the Promotion or acted in violation of these Terms.
   3. McDonald's decision in the exercise or interpretation of any of its rights or discretions in connection with the Terms shall be final and binding. No correspondence will be entered into.
   4. McDonald's is not responsible for any changes to any participant’s email address.
   5. McDonald’s and CHILI reserve the right to validate any claim and may ask for proof of identity, address and/or age for the purposes of verifying eligibility and any activation and/or movie rental code may be withheld unless and until McDonald's and CHILI (as applicable) is satisfied with the verification.
   6. McDonald's reserves the right to terminate, cancel, suspend, or amend the terms of the Promotion (or any part of it), with no liability to any participants or third parties, if it considers it necessary to do so due to circumstances outside its reasonable control. McDonald’s shall not exercise this right unreasonably and if this happens, McDonald’s shall use all reasonable endeavours to avoid consumer disappointment.
   7. These Terms, and any dispute arising out of these Terms, shall be exclusively governed by and interpreted in accordance with English law and entrants submit to the exclusive jurisdiction of the English Courts, unless you live in another part of the UK, in which case your local courts will have jurisdiction.
